CONVICTED FELON SENTENCED ON MURDER CHARGE

Clovis, NM – Ninth Judicial District Attorney, Quentin Ray, announced that on September 26, 2024, Jimmy Whitlock, age 45, of Clovis, pled guilty to Murder in the second degree and was sentenced to 15 years in the Department of Corrections. 

On August 14, 2022, Clovis Police Department responded to 1100 Sycamore for a shots fired call.  Upon arrival officers located a 16-year-old male who sustained a gunshot wound and succumbed to his injuries. After a thorough investigation it was determined that an eyewitness and his 11-month-old son were at their residence on Sycamore hanging out with the 16-year-old mentioned when they heard knocks at the door. The witness opens the door and Whitlock and another male rush in and began to batter the witness.  The 16-year-old tries to help the witness, and Whitlock pulls out a firearm and shoots him.  The incident was captured on video by the homeowner’s security cameras.  

Today, Judge Benjamin Cross sentenced Jimmy Whitlock to 15 years in the Department of Corrections where he will have to serve 85% of his sentence due to the Judge finding that it is a serious violent offense.  Once Whitlock completes his sentence he will be released on Parole.

The case was prosecuted by Chief Deputy District Attorney, Jake Boazman and Whitlock was represented by Criminal Defense Attorney, Sandra Gallagher of Portales.  The Honorable Judge Benjamin Cross presided over the hearing. 

This last year, the legislature increased the maximum penalty for second degree murder from 15 years to 18 years. This crime occurred before the legislative change and was the maximum possible sentence for second degree murder. My office will continue to push the legislature for further increases in punishment on violent crimes.
