Clovis, NM: Ninth Judicial District Attorney, Andrea Reeb, announced that today, Francisco Hernandez, age 34, of Clovis, was found guilty by a Curry County jury of two petty misdemeanors: Embezzlement $250 or less and Tampering with Evidence.
In December 2019, the Clovis Police Evidence technician notified Captain Roman Romero of some discrepancies in the evidence reporting by Officer Hernandez. Cash was later located in Officer Hernandez’s desk. After an investigation by the department, it was determined that the cash was taken from an individual by Hernandez during an arrest and was never logged in to evidence or returned to its owner, but instead Hernandez placed it in his desk drawer and eventually spent the money.
The Honorable Karen Mitchell presided over the case and sentenced Hernandez to 364 days, which was suspended in favor of supervised probation.
Chief Deputy District Attorney, Brian Stover prosecuted the case for the State and criminal defense attorney, Christopher Christensen, of Portales, represented Hernandez.
